A Delaware Business Presence

If your business needs to actually do business in Delaware, or if the activity you require in Delaware qualifies you as "doing business" in Delaware, this is the package you will need.


This service is still a "virtual" service in that we will allow limited use of our facilities to maintain your business presence in the State, but you will have no property rights at our office.


Doing business is defined differently in each of the fifty states and the District of Columbia. In general, you must register, and pay taxes, in any State or jurisdiction where you have an office, employee or economic nexus. The term economic nexus is intentionally vague since there is such wide variation between and among the states. In Delaware we do not have a hard and fast rule for doing business. There is a questionnaire available that you may fill out and send in for review by the State Division of Revenue. They will reply in about two weeks with an answer as to whether your activities constitute doing business.


You should be aware that there are some specific exclusions from the filing requirements for corporate taxes. They can be used as a general guideline for determining if you are doing business in Delaware or not.


Please note that establishing a Delaware Business Presence will involve, but may not be limited to, obtaining a Delaware Business License. You may purchase our Business License Acquisition Service or apply for a Delaware Business License independently with the Division of Revenue.

    Please enter the name of the entity that would like to establish a business presence. Delaware Intercorp, Inc. must be the registered agent for this entity in order for you to purchase the business presence service.


    *Business Presence Packages
    Use of this service will require you to obtain a business license. The service is designed specifically for the purpose of allowing you to pay taxes in Delaware. When you order this service you must either order our business license acquisition service or you must apply for and obtain your own. This service includes display space on our office directory for your business license.

    This is a virtual lease of our office and there are no rights to any actual physical space. Your business license must be mailed to and posted at our address, as required by State law.

    Prices are for service from January 1 to December 31st. In order to align our services with Delaware's annual business license requirement, the cost is prorated from the date of the order through December 31. Please call or write for a quote.
