Procuring a Delaware Business License

Business License Procurement is really signing up to pay taxes in Delaware. When you apply for the business license you are saying to the State "I do business here and would like to set up a tax account".

Delaware Intercorp, Inc., can help you get your business license or you can do it yourself with the State of Delaware Division of Revenue. They provide forms you may send in. Expect to have your license sent to our office in approximately four weeks.

If you need anything other than a general services business license there will be additional fees. The general services license costs $75.00 per year. You will be billed and you may pay the annual license fee by check directly to the State. After the initial service, you may administer your license yourself. If you fail to get a new license by February of the new year we will terminate your business presence package. You must maintain a license if you wish to use the business presence package. And, you must have purchased a presence package if you intend to get a business license at this address.

The Division of Revenue will expect the following tax filings once you set up your tax account:

• Corporate or partnership annual return of income
• Quarterly payments of income taxes (IRS C Corporations)
• Gross receipts tax, applicable above $150,000.00 per quarter but must file regardless of receipts
• Payroll withholding if you employ workers
• Unemployment Insurance if you employ workers

Delaware Intercorp will obtain a Delaware General Services Business License for your company. A temporary license will be obtained within 3 business days with the license certificate following in approximately one month. The license will be posted conspicuously at our location as required by State law. Please note that the license issuance will trigger filing requirements with both the State of Delaware Division of Revenue (Income, Gross Receipts, etc. taxes) and the United States Internal Revenue Service. Your company MUST have a Federal Tax Identification Number (EIN) to make use of this service.

Referrals are available to Delaware accountants and attorneys should you need help in making your tax filings. It is the client's responsibility to determine what filings may be required or advisable.
